TERMS OF USE POLICY
The Mountain West Outdoor Club, Inc. (“MWOC”) is a 501(c)7 tax-exempt, non-profit social club incorporated in the State of Idaho for the recreational and educational benefit of its members.
Purpose: This Terms of Use Policy describes the responsibilities of the MWOC administrators (“MWOC”) and its members (“Members”) in, respectively, maintaining and using the club’s website. MWOC and Members agree to abide by these terms. Note that a separate Liability Waiver (terms and conditions) must be accepted by members upon initial membership application and annual renewals.
Definitions: “MWOC” is the Mountain West Outdoor Club, Inc.; “Members” are persons who have applied and been approved for membership, signed the Liability Waiver, and paid appropriate membership dues; “website” refers to the set of webpages hosted at https://mountainwestoutdoorclub.wildapricot.org/; “Wild Apricot” is software licensed from the Personify Corporation.
Member Rights and Responsibilities:
Members agree to:
- Create and keep secure a compliant password for accessing the non-public pages of the MWOC website
- Post on the website and in emails only content that is:
- material to which they have legal rights
- clearly relevant to the club’s mission
- not offensive to a reasonable individual
- not political or propaganda in nature
- not likely to damage the reputation, sustainability, or legal status of the MWOC
- Abide by the Intellectual Property Rights described later
- Keep confidential other Members’ contact information available to all Members in the Directory
Members furthermore agree not to:
- Use the MWOC website for personal gain, expression unrelated to the club’s mission, and other activities that are illegal or that a reasonable person would find objectionable
- Use MWOC data for spamming
- Hack into restricted areas of the MWOC website and Wild Apricot for which they do not have permissions
MWOC Rights and Responsibilities:
MWOC agrees to:
- Use due diligence to protect Members’ confidential information
- Use third-party widgets (for website features) only from reliable sources
- Within a reasonable timeframe, keep current the website’s content and settings
- Address technical website issues that are within MWOC administrators’ ability to correct
- Communicate with Members concerning MWOC website or Wild Apricot performance and access to club benefits
Intellectual Property Rights:
MWOC retains ownership of all material on the MWOC website, except:
- Images and written content owned and provided by Members
- Images and content licensed from third parties
- Code, images, content, processes, and other intellectual property owned by Personify Corporation and its partners
Unless the Fair Use Doctrine applies, Members must request use of MWOC-owned intellectual property by writing to the club at the addresses shown at the end of the policy. Granting of rights is at the discretion of MWOC officers. An example of MWOC-owned intellectual property is the club’s official logo.
Privacy Policy: MWOC and its Members agree to abide by the MWOC Privacy Policy.
Disclaimers: The MWOC is not liable for damages arising out of a Member’s use of the MWOC website, or for any failure of performance, error, or omission; computer virus or line or system failure; or unauthorized access to, alteration of, or use of Member information or property. In no instance shall MWOC’s cumulative liability exceed a Member’s current-year membership dues.
Governing Law and Dispute Resolution: This Policy shall be construed in accordance with, and governed by, the laws of the State of Idaho.
Changes to Terms: MWOC reserves the right to modify the Terms of Use at any time and shall notify Members by email of any changes.
Termination: Membership in MWOC may be terminated if a Member fails to pay membership dues, violates the club’s Bylaws, or fails to adhere to the terms and conditions of club policies.
